WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND RELEASE OF CLAIMS

Spring Pop-Up Exhibition Series

We’re excited to welcome you to the Spring Pop-Up Series, curated by JAKUPSIL and hosted by Style& Haus. This event is taking place in a space that is not fully finished for lease. To ensure the safety of all artists, guests, and organizers, we ask that all attendees read and sign the following waiver.

This Waiver of Liability (the "Agreement") is entered into by the undersigned participant or guest (the "Participant") in consideration of the opportunity to enter and attend the Spring Pop-Up Exhibition organized by JAKUPSIL, in partnership with Style& Haus (the "Organizers").

1. ASSUMPTION OF RISK
I understand that the venue for this event is a construction site and does not currently possess a certificate of occupancy. The premises may contain potential hazards, including but not limited to uneven flooring, exposed building materials, construction debris, dust, and limited lighting or ventilation. I voluntarily assume all risks, both known and unknown, associated with attending the exhibition in such conditions.

2. RELEASE OF LIABILITY
I hereby waive, release, and discharge JAKUPSIL, Style& Haus, their owners, directors, officers, employees, agents, volunteers, affiliated entities, and event staff from any and all liability, claims, demands, or causes of action arising out of or related to any loss, damage, illness, injury, or death that may occur during or in connection with my attendance at the Spring Pop-Up Exhibition.

3. HOLD HARMLESS AND INDEMNIFICATION
I agree to indemnify and hold harmless the Organizers from any claims, including attorneys’ fees and costs, arising out of my actions or conduct while at the event premises.

4. VOLUNTARY PARTICIPATION
I acknowledge that my participation in or attendance at this event is entirely voluntary. I am not under any obligation or employment requirement to be present.

5. HEALTH & SAFETY RESPONSIBILITY
I agree to follow all posted signage and instructions given by the Organizers or staff during the event. I understand that failure to comply may result in removal from the premises.

​​6. SEVERABILITY
If any portion of this Agreement is found to be invalid or unenforceable, the remaining sections shall remain in full force and effect.

7. GOVERNING LAW
This Agreement shall be governed and construed in accordance with the laws of the State of New York.

By signing below, I acknowledge that I have read and fully understood the contents of this waiver, and that I am voluntarily giving up substantial legal rights by signing it.
